1. Who we are, what this is
TapToCast (the "Service", "we", "us") is a software preview operated as a personal, non-commercial demonstration. The Service is not a casting agency, talent agency, talent manager, employer, employment agency, or licensed advance-fee talent service. We are not affiliated with SAG-AFTRA, any production listed in sample content, or any individual depicted in sample profiles.
2. Acceptance
By accessing or using the Service you accept these Terms, our Privacy Policy, Acceptable Use Policy, AI Use Policy, and Copyright Policy. If you do not accept any of them, do not use the Service.
3. Eligibility
You must be at least 18 years old to use the Service on your own behalf. Minors may only appear in sample content if represented by a parent or legal guardian. See our Children's Privacy policy.
4. The Service is illustrative
All breakdowns, roles, talent profiles, reels, ratings, statistics, activity feeds, and match scores shown on the Service are fictional samples created to demonstrate product behaviour. They are not real opportunities, not real people, and not endorsements. Any resemblance to real productions, persons, or events is coincidental or used illustratively under fair use.
5. Accounts, submissions, and payment
- Signed-in workflow state, including submissions, shortlists, board notes, saved searches, media records, workspace invites, messages, and NDA access receipts, may be stored server-side for auditability and collaboration.
- Demo browsing may still use browser-local sample state when the production API is not available.
- We will never ask you for payment, banking information, government identification, or intimate imagery. See Scam Safety.
6. Your conduct
You agree not to do anything prohibited by our Acceptable Use Policy, including but not limited to: scraping, automated access, reverse engineering, impersonating a casting director or talent representative, soliciting payment from actors, or uploading content you do not have the right to share.
7. Intellectual property
The Service, its design system, source code, and original sample content are © TapToCast and its licensors and are protected by copyright, trademark, and other laws. You receive a personal, revocable, non-exclusive, non-transferable licence to use the Service as offered. You receive no other rights.
Any "sides" or pre-production material shown is confidential and additionally governed by the click-wrap NDA presented before access.
8. AI training opt-out
All pages, sample content, code, and other material on the Service are reserved from text-and-data-mining and from use as training data for machine learning systems, in accordance with EU CDSM Directive Art. 4(3), the EU AI Act, and equivalent rights elsewhere. See AI Use Policy.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TAPTOCAST, ITS OPERATORS, OFFICERS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR EMPLOYMENT OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US $100), WHICH YOU ACKNOWLEDGE IS A REASONABLE ALLOCATION OF RISK GIVEN THAT THE SERVICE IS PROVIDED FREE OF CHARGE AS A PREVIEW.
11. Indemnity
You will indemnify and hold TapToCast harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Termination
We may suspend or terminate your access at any time, with or without notice. The Service is a preview and may be modified, paused, or discontinued at any time.
13. Governing law & arbitration
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules. You waive any right to participate in a class, collective, or representative action. You may opt out of arbitration within 30 days of first use by emailing legal@taptocast.com with the subject "Arbitration opt-out".
14. Changes
We may update these Terms by posting a revised version at this URL with a new "Last updated" date. Material changes take effect 14 days after posting. Continued use means acceptance.
